Firing an employee is not the most preferable thing to do, for most of us. However, no matter how much you are fed up with an employee, you must be cautious about the ways of firing someone in order to avoid being involved in lawsuits:
- You must be careful in firing just as you were when you hired the employee. Before speaking to the employee, you have to reread your company’s policies, consult someone you trust in the company, make sure you have tried everything before you got to this point and grant your employee all possible chances to improve.
You might sometimes want to do the process quicker than other times. If you want more time to think about it all, you can just put the employee on the unpaid leave until you get everything done.
- Do not ever lie about the reason of firing. Many managers often fire people because of their poor performances, yet they say that they just want to economize. People are not stupid. They can know that you are not telling the truth. If you lie, you will lose credibility. Therefore, never document the termination for an untrue reason.
- Once again, no matter how angry you are and how eager to fire an employee, you should consider reviewing the money you owe them for days off, expenses and other dues. Several managers get the termination done without checking this issue, and when the employee looks deeper into the documents, he will use anything to suit your company, and it’s just because they have families to take care of and they feel disrespected.
If you want to resort to the compensation solutions, you are not legally obliged to do that. Think wisely and consider giving your fired employee a severance, mainly the ones who worked for your company for a long time.
- The termination meeting should not be your playground. Do not try to argue and please yourself with winning the argument. Since you are firing the employee, then you’re the winner, no need for more to say. Or else, you may be risking being suited.
At last, consider you are being fired. How would you like to be treated? DO you want to be disrespected? Humiliated? Of course not. Treat people the same way you like to be treated.
